SPRINGFIELD, Ill. – An Illinois appellate court has thrown out a Peoria man’s conviction related to a 2022 shooting.
The Fourth District Appellate Court ruled last week that now-31-year-old Kevin Boyce’s conviction on a charge of Possession of a Weapon by a Felon must be thrown out, because he wasn’t tried within 120 days of the charge being filed under the state’s speedy trial statutes.
At issue, the court ruled, was the fact that Boyce’s eight year sentence was calculated based on that charge being filed after Boyce was initially arrested on an aggravated battery charge that was later withdrawn.
Boyce was arrested in late-August of 2022 for a shooting on Brandywine Drive. The female victim in the case reportedly identified Boyce as the man who shot her.
It’s not clear when Boyce might be released from the Shawnee Correctional Center.
