CHICAGO, Ill. – An Illinois appellate judge will hear arguments from both sides on Tuesday to decide whether disgraced actor Jussie Smollett should be sent back to the Cook County jail to serve the rest of his sentence.
In December 2021, Smollett was sentenced to 5 months in jail on five felony counts of lying to police about a homophobic and racially-motivated attack hoax in 2019, but he only spent six days behind bars before being released pending an appeal.
Fox News reports the judge is not expected to rule immediately, and Smollett’s attorneys say he won’t be present for the proceedings.
