PEORIA, Ill. – A Peoria man with a prior felony weapon charge will spend more than four years in a federal prison.
21-year-old Eshayah Aguirre was sentenced to 51 months in federal prison on Tuesday, followed by three years of supervised released.
The sentencing is the result of a May 25th incident with Peoria Police. Aguirre was convicted of a felony possession of a weapon offense in January.
Federal authorities at the sentencing hearing talked about the May 25th incident. They said Aguirre was a passenger in a vehicle that was stopped by Peoria Police.
Authorities said Aguirre struck an officer in the head and knee with a door during the traffic stop, then fled on foot. He then pulled out the weapon from his waistband, but then immediately tripped and fell.
Aguirre was then arrested by police and recovered the gun, a loaded semi-automatic pistol and 20 additional rounds of ammunition. He claimed ownership of the weapon and that it was needed for self-defense.
As a felon, Aguirre could have faced up to 10 years in prison and a $250,000 fine.
