PEORIA, Ill. – An Alabama man that was released in accordance with the state’s Pretrial Fairness Act after allegedly pointing a gun at a Peoria Police officer is back in jail.
The Peoria Police Department says Brian Childers, 45, was taken into custody at around 4:00 P.M. Friday on a No Bond Arrest Warrant issued by Tazewell County. The warrant listed charges of Armed Violence, and two counts of Possession of Methamphetamine.
Childers allegedly pointed a gun at a Peoria Police officer during an attempted traffic stop Monday morning in South Peoria. He was arrested later in the day at the Par-A-Dice in East Peoria.
Childers was released by Judge Mark Gilles on Tuesday in accordance with the state’s Pretrial Fairness Act, citing his lack of a criminal history.
Peoria Police Chief Eric Echevarria blasted the decision at a press conference on Wednesday. In a statement issued Friday, Echevarria expressed relief.
“I want to take this opportunity to thank Tazewell County for taking swift action in the issuance of
this warrant, which allowed Peoria Police to take this dangerous individual of [sic] the streets,” said Peoria Police Chief Eric Echevarria, in a statement.
A Peoria Police spokesperson confirms the warrant was issued in relation to the incident ending in East Peoria, following a review of the case by the Tazewell County State’s Attorney and Tazewell County prosecutors.
Childers had been scheduled to appear in Peoria County Circuit Court May 2 for arraignment. It’s likely he’ll have a date in Tazewell County Circuit Court sooner than that.
